Terms and Conditions of Membership

RESULTS MEMBERSHIP

Results membership involves a commitment from you to meet a full year’s membership in return for a reduced joining fee. You agree that monthly membership fees will be paid each month in advance of Village Hotel providing services pursuant to this agreement for the month of receipt of such membership fees. If you cancel your direct debit without due cause during the 6 or 12 months from agreeing to the contract (save in the event of a material breach of contract on the part of Village Hotel or where provided for in the terms and conditions overleaf) all monthly fees for the outstanding time are due immediately. At the end of the minimum term your membership will automatically convert to a non-results membership and applicable fees will continue to be collected monthly.  Alternatively, if you wish to terminate your membership on expiry of the minimum term you must give one full months’ notice in advance of expiry of the minimum term (clause 2.4). You understand that save in the event of a material breach of contract on the part of Village Hotel, a results membership cannot be cancelled, transferred or downgraded to a cheaper membership during the initial 6 or 12 month period, unless provided for in the terms and conditions overleaf. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

FLEXIBLE MEMBERSHIP

Flexible membership involves a commitment from you to pay your monthly subscription fees in advance by direct debit. Members agree that monthly membership fees will be paid each month in advance of Village Hotel providing services pursuant to this agreement for the month of receipt of such membership fees. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

Agreement MUST be consented by Parent or Guardian if under 18yrs of age

ADVANCE PAID MEMBERSHIP

Advance paid membership involves a commitment from you to pay in advance for the agreed term of 1, 6 or 12 months.  Members agree to pay the membership fee upon entering into this agreement and in advance of Village Hotel providing services pursuant to this agreement for the paid membership term. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

Agreement MUST be consented to by Parent or Guardian if under 18yrs of age

 

GENERAL

Village Hotels is the trading name of VUR Village Trading No 1 Limited, a company incorporated in England and Wales with registered number 418878. (‘Village’).

In these terms and conditions (‘you’ and ‘your’) means you the member, (‘we’ ‘us’ and ‘our’) means Village.

All memberships are subject to: (1) these Terms and Conditions of Membership; (2) the General Terms and Conditions of Use of Village gyms; and (3) the rules and regulations issued by individual Village gyms from time to time. By agreeing to become a member of Village gyms, you accept and agree to comply with all terms, conditions, rules and regulations. These terms and conditions take precedence over any previous terms and conditions or any oral representations made.

MEMBERSHIP

We offer different types of gym membership (fees vary between membership types and locations):

All memberships are sold on either a full access or restricted access basis.

2.1 RESULTS MEMBERSHIP

2.1.1 If you have a Results Membership you will be committed to a minimum of 6 months’ or 12 months’ membership.

2.1.2 Your membership fee must be paid in monthly instalments for a minimum of 6 months or 12 months and the commitment period begins on your membership start date.

2.1.3 Monthly instalments are paid by direct debit, in advance of us providing the services for the month to which the payment relates.

2.1.4 If you cancel your direct debit during the minimum term, all unpaid monthly instalments that are due or to fall due during the minimum term shall become immediately due and payable by you.

2.1.5 If you want to cancel your Results Membership on expiry of the minimum term (on the expiry of the 6 months’ or 12 months’ period) you must give us one full month’s advance paid notice (Please see the terms regarding giving notice in clause 2.4 below).

2.1.6 It is important for you to note that you cannot cancel or downgrade your Results Membership to another form of membership during the minimum term, other than in the exceptional circumstances set out in these terms and conditions below.

2.2 FLEXIBLE MEMBERSHIP

2.2.1 If you have a Flexible Membership you can terminate this at any time, upon one full month’s notice. (Please see the terms regarding giving notice in clause 2.4 below).

2.2.2 Your membership fee must be paid monthly, by direct debit, in advance of us providing the services for the month to which the payment relates.

2.2.3 It is important for you to note that you cannot cancel or downgrade your Flexible Membership to another form of membership during the minimum 1 months’ paid notice period, other than in the exceptional circumstances set out in these terms and conditions below.

2.3 ADVANCED PAID MEMBERSHIP

2.3.1 If you have an Advance Paid Membership you will be committed to and you must pay us in advance and in full, for the agreed 1 month 6 month or 12 months’ minimum membership period.

2.3.2 It is important for you to note that you cannot cancel or downgrade your Advanced Paid Membership to another form of membership during the minimum 1 month or 6 months’ or 12 months’ period, other than in the exceptional circumstances set out in these terms and conditions below.

2.4 NOTICES

2.4.1 All memberships are calculated in whole calendar months. This means that if we ask you to give notice of one calendar month, and you give notice in that month, we will treat it as if we received it on the first day of the following month and the notice period will start from that day. (For example: notice to terminate a flexible membership given on 19th May will be treated as starting on 1 June, and the membership will terminate on 30 June).

2.4.2 If we ask you to give 90 days’ paid notice, the 90 days’ notice period will start on the day the valid termination request is received. For example: if the termination notice is received 03 April, your membership will terminate on 02 July

2.4.3 If you want to give us notice, such notice must be given by sending an email to the following email address: memberservices@village-hotels.com. It is your responsibility to ensure that all postal addresses and email addresses are correct.

2.4.4 Cancellation of your direct debit instruction is not accepted as a request to terminate your membership.

CHOICE OF HOME CLUB

3.1 All memberships granted prior to April 2015 have reciprocal rights of other clubs other than the Home Clubs.

3.2 For memberships granted after April 2015, the following terms shall apply:  You must select One Village hotel whose gym and leisure facilities that you would like to use. This will be known as your “Home Club”.

3.3 You will be entitled to use your Home Club facilities, subject to the relevant terms and conditions of your membership, the General Terms and Conditions of Use of Village gyms, and the rules and regulations specific to the Home Club.

4.1 TERMS AND CONDITIONS

4.1.1 Subject to clause 4.1.2 we will give you at least 14 days’ notice, or less if it is not reasonably practicable to give 30 days’ notice, in respect of any change to your membership conditions.

4.1.2 We will give you at least 14 days’ notice, of any proposed price increase of your membership.

4.1.3 In the event that a material change or a price increase is made to your membership terms and conditions, you shall be entitled to terminate your membership by providing one full calendar months’ notice to us as outlined in 2.4.1, within fourteen days of receiving the notice of the material change or the price increase.

4.2 CANCELLING OR CHANGING YOUR MEMBERSHIP

4.2.1 Subject to the provisions of this clause you cannot cancel or downgrade your membership during its minimum term. The minimum term for each membership is set out above and is repeated as follows: Results Membership (6 month or 12 months plus any relevant notice period (if applicable); Flexible Membership (1 month) Advance Paid Membership (1, 6 months or 12 months).

4.2.2 You may only cancel or change your membership to another type during its minimum term if the following exceptional circumstances apply:

(i) You suffer a long-term illness or injury;

(ii) You become pregnant;

(iii) You lose your livelihood or have a change in your principal place of work or home

If any of the above exceptional circumstances apply, we shall be entitled to request reasonable evidence to provide sufficient proof of the exceptional circumstance. The decision as to whether the membership can be cancelled shall remain in our absolute discretion.  If we agree to cancel your membership in exceptional circumstances the notice period shall be 1 paid calendar month for all types of memberships.

4.2.3 Any change to your membership must be made by you by 20th of the month either online, or by calling the Member Services Team or sending an email to memberservices@village-hotels.com. Any changes made shall incur a reasonable administration fee (details of such notice periods and administration fees are available on request). Changes to your membership requested after 20th of the month may not be valid until a later month.

4.2.4 Any cancellation of your membership must be made by you by calling the Member Services Team or by sending an email to memberservices@village-hotels.com. Cancellation of your membership requested after the required notice period may not be valid until a later month. For all cancellations we require a cancellation reason and requested date to stop the membership.

4.2.5 Joining fees and subscriptions will not be refunded, save in the event of a serious breach of these terms and conditions on our part.  We hope that our Village Gym provides everything you expected.  However, if you do change your mind within 10 days of your start date, we will allow you to cancel your membership but your joining fee, or if no joining fee was payable a minimum of £15, will not be returned by us and will not be refunded.

4.2.6 Junior (under 14 yrs), 14-15 yrs & Young Persons (16 - 22 yrs) memberships will be based on age and, if relevant, will automatically increase from the month following each birthday, moving to the membership category relevant to their age. When a child becomes 18yrs old they will become an adult member and the responsibility for the membership agreement will transfer to them from the parent/guardian.

4.3 CHANGING YOUR DETAILS

It is your obligation to ensure that your contact details are up to date. Please ensure any changes to your postal or email address or telephone number are notified to us. We cannot be responsible for any communications that you do not receive because you did not update your contact details with us.

4.4 PAYING YOUR MEMBERSHIP FEE

4.4.1 If you do not pay your membership fee we will contact you to let you know.

4.4.2 We may refer any missed payments to a debt collection agency.

4.4.3 If you do not pay your membership fees for more than 30 days, we may at our discretion charge you an administration fee of £25. We may also charge you an administration fee of £10 for each missed payment.

4.4.4 If you do not pay for your membership we will prevent you from using the gym.

4.4.5 If you want to change your direct debit mandate from one bank to another you can change this by either using your online account, by calling member services or sending an email to memberservices@village-hotels.com by the 20th of the month. Failure to do so will result in the payment being requested from your existing bank account – should there be insufficient funds to cover the payment you may incur bank charges.

4.5 PRICING

4.5.1 We reserve the right to increase prices of the membership at any point during the term of the membership. We will give you at least 14 days’ notice of any price changes.

4.5.2 We reserve the right to pass on in full any changes in the prevailing rate of Value Added Tax (V.A.T.).

4.5.3 When a standard price increase is made, you are entitled to terminate the remainder of the membership by providing one month’s notice to us, within fourteen days of receiving notice of the increase.

4.6 FREEZING MEMBERSHIP

4.6.1 You may request to freeze your membership via your online member’s account or by contacting the Member Services Team. You must notify us by calling the Member Services Team or by sending an email to memberservices@village-hotels.com by the 20th of the month prior to your freeze start date. Membership may be frozen at our absolute discretion for a minimum of 1 month and a maximum of 12 months, such period to be agreed at the time of freezing the membership.

4.6.2 A charge of £10.00 per month will be levied for the duration of the freeze period.

4.6.3 Full membership fees will be re-instated and will commence from the agreed commitment to return date received from you.

4.6.4 Periods during which the membership is frozen do not form part of the continued duration of a Results Membership and periods for which the membership is frozen will be added on to the contract term, extending the minimum term.

4.6.5 You must fully re-instate your membership subscription from frozen to active membership before terminating your membership, giving the required notice period as set out in clause 2.4.1.

4.6.6 You will not have access to use the club facilities during periods of freeze.

USING THE CLUB

5.1. MEMBERS’ ACCESS

5.1.1 You will receive a membership card (or other membership pass prescribed by us from time to time) to gain access to your Home Club.

5.1.2 An administration fee will be charged to you for a replacement membership pass

5.1.3 We reserve the right to refuse entry to the gym without a membership pass.

5.2. USING OTHER CLUBS

5.2.1 Subject to clause 3.1 you can use other Village gyms in the Village group subject to you either upgrading your membership or paying a daily guest fee. Please note that access to the Village gyms at Village Hotel Aberdeen, Village Hotel London Watford, Village Hotel Eastleigh and Village Hotel Bracknell requires a daily guest fee in all circumstances

5.2.2 Members’ visits to their Home Club must be a greater number than visits to other Village gyms, over a rolling three months’ period. If the member uses other Village gyms more than their Home Club, Village has the right to transfer the membership to the club used the most. This may mean the member having to pay a higher membership fee.

5.3. CHILDREN

5.3.1 Each adult member can apply, at Village gym for a maximum of three junior memberships, for children up to & including 13 years of age.

5.3.2 At the age of 14 years, junior members may move to an upgraded 14-15 years’ membership and use all the facilities (subject to the terms and conditions of membership, the terms and conditions of use and the completion of a General Health Questionnaire prior to using the gym and/ or classes). A full Fitness Orientation must take place prior to joining onto this upgraded category.

5.3.3 Children must be supervised at all times as follows:

(i) All children aged 13 and under must be supervised directly by a parent or guardian, aged 18 or over. Those 14 and 15 year old must have a parent or guardian in the club at the same time at which they are in attendance.

(ii) There must be at least one parent or guardian for every child under the age of 5 years.

(iii) There must be at least one parent or guardian for every two children between the ages of 5 and 8 years.

5.3.4 No child under the age of 14 years is allowed in the pool area unattended.

5.3.5 Children, including junior members under 14 years, must be accompanied and supervised at all times by a parent or guardian, unless attending supervised junior activities. Children remain the responsibility of their parent or guardian at all times while on Village premises and their parent or guardian agrees to ensure that each child adheres to the applicable terms, conditions, rules and regulations. Children may not use the fitness and aerobics studio (except during designated, supervised sessions), whirlpool spa, steam room or sauna.

5.3.6 Children over the age of 8 years should use own sex changing rooms.

5.4. GUESTS

5.4.1 Subject to availability you may introduce up to two guests on any day to the gym. Guests must register, complete a club waiver form, pay the current guest fee (details of which shall be provided on request) and must be accompanied by you. We are not able to take advanced booking for guests.

5.4.2 You must ensure that your guests are fully aware of and adhere to the applicable, terms, conditions, rules and regulations.

5.5. LOCKERS

5.5.1 For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.

5.5.2 All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.

5.6. ADVANCE BOOKINGS

5.6.1. You may book any bookable facilities up to 7 days in advance online via your online member access area or at the booking terminals within the Club.

5.6.2. All booked facilities/activities will be automatically checked in when swiping into the Club. This must happen prior to the activity starting otherwise your place maybe taken by another member.

5.6.3. Any facilities or classes can be cancelled a minimum 4 hours before the start time and will incur no penalties. Any classes that are cancelled after the 4 hour cut off period cannot be cancelled online. In the event of not cancelling 4 hours prior to the start or a no show will incur a penalty strike. Three penalty strikes accumulated in a 30 day period will result in a suspension of booking privileges for a 14 day period. To cancel a class after the 4 hour cut off period has passed can only be done by contacting the Club and requesting to cancel. No penalty will be applied if the space is filled by another member. Booking penalties can be appealed by contacting the Club Manager.

5.7. SMOKING

Smoking and the use of vapours is prohibited in all areas of Village premises.

5.8. PERSONAL BELONGINGS

We do not accept liability for loss, theft or damage to any personal belongings.

GENERAL USE

2.1 Prior to using any facilities at a Village gym you must complete a General Health Questionnaire. If there are some answers that indicate you have a medical condition, we may require a doctor’s note.

2.2 You must advise staff of any disability, including but not limited to blindness, deafness, heart condition and epilepsy, prior to using the facilities. This will help us in seeking to avoid accidents, injuries or misadventures to you and others.

2.3 While using the facilities you accept responsibility for your state of health and physical condition. You should not take part in any physical activity that you may not be fit for. If you suffer any unusual symptoms when using the gym facilities, you must immediately stop the activity and tell a member of staff.

2.4 You must not use the facilities if you have an infectious disease or condition.

2.5 If you or any guest or child that is with you suffers an accident or injury on the Village premises, it must be reported immediately to the most senior staff member on duty.

2.6 You must behave appropriately, respectfully and dress appropriately whilst on Village premises.

2.7 No pets are permitted on Village premises or its grounds, with the exception of registered working assistance dogs.

2.8 Smoking and use of vapours is prohibited in all areas on the Village premises.

2.9 No illegal gaming and betting is allowed on Village premises.

2.10 Shaving should be restricted to the vanity areas provided and is not permitted at any time in the shower, steam room, sauna or any other part of the gym.

2.11 All facilities may not be available at all gyms.

2.12 It may be necessary for us to close or withdraw all or any part of the gym facilities at any time for repair, maintenance, alteration or for safety reasons.

STUDIO ACTIVITIES

3.1 You must wear appropriate clothing and footwear at all times.

3.2 For your health and safety you must warm-up before taking part in any classes. If you arrive after the warm-up you may be excluded from participating for safety reasons.

3.3 Drinks may only be taken into the aerobics studio in a plastic re-sealable container

FITNESS STUDIO

4.1. In the interest of safety, no person under the age of 14 years will be admitted to the gym on their own (except during designated, supervised sessions). 14 - 15 year olds may only be admitted to the gym providing their parent or guardian is in the club.

4.2 All equipment has been designed and tested to be safe with the correct use. You must ensure for your own safety that you receive full instructions before using such equipment.

4.3 You must obtain prior permission to use the studio for a non-timetabled class.

4.4 You must only attend a class on which you have pre-booked in advance or on the day.

LEISURE POOL AREA

5.1 You must shower on entering the pool area, especially before and after using the sauna or steam room, and always shower immediately before entering the spa pool.

5.2 You must read and observe the notices displayed in the pool area.

5.3 You must at all times follow the rules and guidelines displayed, and any other instructions given by Village staff, regarding the use of the pool, spa, sauna and steam room.

5.4 For safe spa bathing, visits are limited to a maximum of 15 minutes.

5.5 No child under the age of 14 years is allowed in the pool area without the supervision of a parent or guardian aged 18 or over. The parent or guardian shall ensure that the child is fully aware of and adheres to these General Terms and Conditions of Use and to any gym specific rules and regulations. 14 - 15 year olds may only be admitted to the pool area providing their parent or guardian is in the club.

5.6 Children not yet toilet-trained must wear an appropriate swim nappy.

5.7 Children must vacate the pool immediately at the end of the designated children’s swimming time. Children’s swimming times may vary slightly from gym to gym - please check published opening times displayed in the gym or on our website.

5.8 You must not enter the pool while under the influence of alcohol or after a heavy meal.

5.9 A poolside telephone or alarm is provided in case of emergency.

5.10 Mobile Phones and any other recording devices are strictly prohibited in the Leisure Pool Area.

CAR PARKING

6.1 You are only entitled to use the car park whilst you are using the facilities.

6.2 Cars must be parked correctly in the car park, giving due attention and priority to disabled users.

6.3 Cars are parked at the owners own risk. We do not accept liability for any loss or damage to vehicles or personal belongings.

6.4 Car parking is not guaranteed at any of the Village premises.

LOCKERS

7.1 For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.

7.2 All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.

7.3 If you lose your wristband or pass then there may be a change to replace these.

TANNING FACILITIES

8.1 Sunshower(s) and sunbeds are available on a queuing basis.

8.2 You must read the health and safety guidelines relating to safe tanning, available from the Village gym reception, before using the tanning facilities.

8.3 Appropriate goggles must be worn at all times in a UVA/UVB environment.

8.4 Tanning facilities are not available to persons under the age of 18 years, in accordance with current legislation.

PHOTOGRAPHY AND VIDEOS

9.1 You must not take photographs or videos of any children under the age of 18.

9.2 You must not take photographs or videos of any other members without their express consent. You must get this consent before photographing or videoing any other member.

9.3 You must not take photographs or videos in a changing area, pool, sauna, steam room, spa or toilet area.

9.4 We may ask you to stop taking photographs or videos and delete them as appropriate.

9.5 Subject to the provisions set out above you are permitted to take photographs or videos of yourself for your own personal use only.

SOCIAL MEDIA

10.1 We operate a safe environment for our staff and guests. As part of that safe environment we ask all guests to use social media in an appropriate manner, having regard to other individual’s privacy.

10.2 Any use of social media identifying our staff or our guests or revealing their personal details will be taken as a serious breach of these terms and conditions and may result in your membership being terminated.

TERMINATION/SUSPENSION

11.1 We reserve the right to terminate membership for any of the following:

11.1.1 breach of rules and regulations;

11.1.2 serious breach of these General Terms and Conditions of Use;

11.1.3 conduct which, in our reasonable opinion, is damaging to the character or interest of the Village gym, or is offensive to other members or staff, hazardous to the health and safety of other members or staff or of significant impediment to the enjoyment of other members.

11.2 We retain absolute discretion to reject any application or renewal of membership without giving any reason for doing so.

11.3 Membership of the gym may be suspended by us if there are any irregularities regarding payments. We reserve the right to appoint a third party to recover outstanding membership fees. Access to the gym may at our discretion be denied until these issues have been resolved. If we think it is appropriate, acting reasonably and at its own discretion, the membership will be terminated.

LIABILITY

12.1 We do not accept liability for any loss or damage to your property that may happen whilst on Village premises, unless such loss or damage is caused by our negligence.

12.2 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude Village’s liability for death or personal injury caused by its negligence, or any liability for fraud.

12.3 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude any rights that members have as consumers.

12.4 We are not responsible for any harm that you suffer as a consequence of using Village gyms and their facilities, unless such harm is caused by our negligence.

DATA PROTECTION

13.1 We agree to comply with all relevant Data Protection Legislation which for the purpose of this Agreement shall mean the UK Data Protection Legislation and any other European Union legislation including the General Data Protection Regulation 2018 relating to personal data and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data (including, without limitation, the privacy of electronic communications)

13.2 We hold any information that you provide to us in accordance with our privacy policy on our website.

GOVERNING LAW

These terms and conditions and any disputes shall be governed by English Law and the parties submit to the courts of England and Wales.

PAYMENT

Privacy Information

Village Gym, as part of Village The Hotel Club process personal information collected for the purposes of, dealing with your requests, providing reservation services, tailoring our services to your requirements and preferences, conducting market research surveys and providing you with information about products and services we offer. We will not sell this information and will only disclose it to other companies within Village The Hotel Club and any suppliers we engage to process data on our behalf.

Direct Debit Guarantee                                                                                        

This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.  If there are any changes to the amount, date or frequency of your Direct Debit, Village Hotels will notify you 10 working days in advance of your account being debited or as otherwise agreed. If you request Village Hotels to collect a payment, confirmation of the amount and date will be given to you at the time of the request. If an error is made in the payment of your Direct Debit, by Village Hotels, or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society.  If you receive a refund you are not entitled to, you must pay it back when Village Hotels asks you to. You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.

Terms and Conditions of Membership

CLUB WAIVER

You understand that exercise and physical activity including the use of equipment is potentially hazardous. You understand that participating in physical activity may result in injury and possibly even death and that you choose voluntarily to take part in these activities. This includes the use of any resistance, or cardio equipment, swimming pool, sauna, steam room and spas, and you are fully aware of the risks involved.

You understand that Village Gym maintain the highest possible standards of health and safety and before you enter the gym you will be asked to complete an online health declaration form to establish your current state of health before starting exercise. You understand that, depending on the answers you provide to the questions on the health declaration, you may need to seek medical advice before beginning any form of exercise and will not be granted access to Village Gym until a medical certificate is obtained. In addition to gym access being denied, if a medical certificate is required, you understand that my membership status will be temporary inactive and you will not be able to use the online members area.

You will assume responsibility for any minors under the age of 18 who accompany you whilst visiting Village Gym. You are responsible for advising Village Gym if your medical circumstances change during your membership term. Some Village Gyms have tanning and solarium facilities included as part of the membership package. You understand that you have read and accept the following terms and conditions relating to tanning and solarium use at Village Gym. Before using the tanning equipment, you agree that you have read and understand your skin type and agree to comply with Village Gym’s recommendations outlined below: 

Skin Type 1

People with very fair/sensitive skin and often with red/strawberry blond hair and freckles, pale blue, pale grey or pale green eyes. People who hardly or never tan.  Recommendations: You should not tan on a sunbed or outdoors. 

Skin Type 2

People with fairish skin who usually burn and sometimes tan. Tend to have light hair, blue or brown eyes.  Recommendations: The EU scientific committee on Customer Products states that people with skin types 1 and 2 should NOT proceed with UV tanning.

Skin Type 3

People with brownish white skins who tan fairly easily, they should respect the fact that they can still burn, especially without a base tan.  Recommendations: Although you tan easily you should respect the fact that you still burn.

Skin Type 4

People with dark skin who tan easily and hardly ever burn, but even so need to be careful that they don’t go through prolonged over-exposure.

Recommendations: You tan easily but should never have more than the full recommended session time.

There are skin types 5 & 6, 5 being naturally brown skin and 6 being brown/black skin. Generally, customers wishing to use sunbeds will fall into skin types 3 and 4.

Tanning should be undertaken with caution. To ensure you tan effectively and responsibly please read the following information before using the solaria:

  • If you have sensitive skin or no existing tan your first few sessions must be limited to 3 minutes, until your base tan has built up.
  • All tans must be built up gradually.
  • Prior to tanning, you must remove all cosmetics, perfumes, deodorants, jewellery & contact lenses.
  • Never use the tanning equipment without eye protection. This is available from leisure reception.
  • If any signs of redness remain from a previous tanning session, you must wait until this clears before your next session.
  • You must not attempt to adjust/tamper with any of the equipment.

You must NOT use the solarium if you:

  • Are under 18 years of age.
  • Have particularly sensitive skin.
    Suffer ill-effects from allergies, cold-sores, epilepsy, dizziness or fainting, a heart condition, headaches or migraine, high blood pressure, hypertension, prickly heat or skin ulcers.
  • Are diabetic, hypersensitive to light, pregnant, taking any form of drug (prescribed or otherwise), using any ointment/lotion, antibiotic or tranquilliser or under medical supervision.
  • Have had hair bleaching, electrolysis or hot waxing in the past 24 hours.

If any of the above applies to you, please consult your doctor before using the solaria.

You declare that you have read and understood the advisory guidelines, and government recommendations not to exceed 20 tanning sessions per year and no more than one session per 24-hour period.

You declare to the best of your knowledge that the information you have provided is correct. You are over 18 years of age, are not affected by any of the above and know of no reason why you should not undertake a tanning session.

This agreement will become binding upon both parties once you have checked the "Agree to Village Gym’s Club. Waiver" box and the "CONTINUE" button has been clicked.

 

TERMS OF MEMBERSHIP

RESULTS MEMBERSHIP

Results membership involves a commitment from you to meet a full year’s membership in return for a reduced joining fee. You agree that monthly membership fees will be paid each month in advance of Village Hotel providing services pursuant to this agreement for the month of receipt of such membership fees. If you cancel your direct debit without due cause during the 6 or 12 months from agreeing to the contract (save in the event of a material breach of contract on the part of Village Hotel or where provided for in the terms and conditions overleaf) all monthly fees for the outstanding time are due immediately. At the end of the minimum term your membership will automatically convert to a non-results membership and applicable fees will continue to be collected monthly and the cancellation period will be 90 days in accordance with clause 2 (below).  Alternatively, if you wish to terminate your membership on expiry of the minimum term you must give one full months’ notice in advance of expiry of the minimum term (clause 2.4). You understand that save in the event of a material breach of contract on the part of Village Hotel, a results membership cannot be cancelled, transferred or downgraded to a cheaper membership during the initial 6 or 12 month period, unless provided for in the terms and conditions overleaf. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

Agreement MUST be consented by Parent or Guardian if under 18yrs of age

FLEXIBLE MEMBERSHIP

Flexible membership involves a commitment from you to pay your monthly subscription fees in advance by direct debit. Members agree that monthly membership fees will be paid each month in advance of Village Hotel providing services pursuant to this agreement for the month of receipt of such membership fees. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

Agreement MUST be consented by Parent or Guardian if under 18yrs of age

ADVANCE PAID MEMBERSHIP

Advance paid membership involves a commitment from you to pay in advance for the agreed term of 1, 6 or 12 months.  Members agree to pay the membership fee upon entering into this agreement and in advance of Village Hotel providing services pursuant to this agreement for the paid membership term. By using the Gym and/or paying membership fees you accept the above membership conditions as well as the full terms and conditions of Village Hotel and will adhere to them accordingly.  You are over 18 years of age.

Agreement MUST be consented to by Parent or Guardian if under 18yrs of age

 

GENERAL

Village Hotels is the trading name of VUR Village Trading No 1 Limited, a company incorporated in England and Wales with registered number 418878. (‘Village’).

In these terms and conditions (‘you’ and ‘your’) means you the member, (‘we’ ‘us’ and ‘our’) means Village.

All memberships are subject to: (1) these Terms and Conditions of Membership; (2) the General Terms and Conditions of Use of Village gyms; and (3) the rules and regulations issued by individual Village gyms from time to time. By agreeing to become a member of Village gyms, you accept and agree to comply with all terms, conditions, rules and regulations. These terms and conditions take precedence over any previous terms and conditions or any oral representations made.

MEMBERSHIP

We offer different types of gym membership (fees vary between membership types and locations):

2.3 Advance Paid Membership

All memberships are sold on either a full access or restricted access basis.

2.1 RESULTS MEMBERSHIP

2.1.1 If you have a Results Membership you will be committed to a minimum of 6 months’ or 12 months’ membership plus 90 days’ notice after expiry of your minimum term.

2.1.2 Your membership fee must be paid in monthly instalments for a minimum of 6 months or 12 months plus 90 days’ notice after expiry of your minimum term and the commitment period begins on your membership start date.

2.1.3 Monthly instalments are paid by direct debit, in advance of us providing the services for the month to which the payment relates.

2.1.4 If you cancel your direct debit during the minimum term, all unpaid monthly instalments that are due or to fall due during the minimum term shall become immediately due and payable by you.

2.1.5 If you want to cancel your Results Membership on expiry of the minimum term (on the expiry of the 6 months’ or 12 months’ period) you must give us one full month’s advance paid notice (Please see the terms regarding giving notice in clause 2.4 below).

2.1.6 If you want to cancel your Results Membership after the expiry of the minimum term you must give us 90 days’ advance paid notice (Please see the terms regarding giving notice in clause 2.4 below) 

2.1.7 It is important for you to note that you cannot cancel or downgrade your Results Membership to another form of membership during the minimum term, other than in the exceptional circumstances set out in these terms and conditions below.

2.2 FLEXIBLE MEMBERSHIP

2.2.1 If you have a Flexible Membership you will be committed to a minimum 3-month term plus 90 days’ notice after expiry of your minimum term.

2.2.2 If you have a Flexible Membership you can terminate this at any time, upon 90 days’ advance paid notice. (Please see the terms regarding giving notice in clause 2.4 below).

2.2.3 Your membership fee must be paid monthly, by direct debit, in advance of us providing the services for the month to which the payment relates.

2.2.4 It is important for you to note that you cannot cancel or downgrade your Flexible Membership to another form of membership during the minimum 90 days paid notice period, other than in the exceptional circumstances set out in these terms and conditions below.

2.3 ADVANCED PAID MEMBERSHIP

2.3.1 If you have an Advance Paid Membership you will be committed to and you must pay us in advance and in full, for the agreed 1 month 6 month or 12 months’ minimum membership period.

2.3.2 It is important for you to note that you cannot cancel or downgrade your Advanced Paid Membership to another form of membership during the minimum 1 month or 6 months’ or 12 months’ period, other than in the exceptional circumstances set out in these terms and conditions below.

2.3.3 The following provisions do not apply to the 1-month minimum membership:

2.3.3.1     Clause 4.6 (Freezing Membership) and;

2.3.3.2     Clause 3 (Choice of Home Club) 

2.3.4 You cannot cancel a 1-month minimum membership; it will expire automatically without notice.

2.4 NOTICES

2.4.1 All memberships are calculated in whole calendar months. This means that if we ask you to give notice of one calendar month, and you give notice in that month, we will treat it as if we received it on the first day of the following month and the notice period will start from that day. (For example: notice to terminate a flexible membership given on 19th May will be treated as starting on 1 June, and the membership will terminate on 30 June).

2.4.2 If we ask you to give 90 days’ paid notice, the 90 days’ notice period will start on the day the valid termination request is received. For example: if the termination notice is received 03 April, your membership will terminate on 02 July

2.4.3 If you want to give us notice, such notice must be given by sending an email to the following email address: memberservices@village-hotels.com. It is your responsibility to ensure that all postal addresses and email addresses are correct.

2.4.4 Cancellation of your direct debit instruction is not accepted as a request to terminate your membership.

CHOICE OF HOME CLUB

3.1 All memberships granted prior to April 2015 have reciprocal rights of other clubs other than the Home Clubs.

3.2 For memberships granted after April 2015, the following terms shall apply:  You must select One Village hotel whose gym and leisure facilities that you would like to use. This will be known as your “Home Club”.

3.3 You will be entitled to use your Home Club facilities, subject to the relevant terms and conditions of your membership, the General Terms and Conditions of Use of Village gyms, and the rules and regulations specific to the Home Club.

CHANGES

4.1 TERMS AND CONDITIONS

4.1.1 Subject to clause 4.1.2 we will give you at least 14 days’ notice, or less if it is not reasonably practicable to give 30 days’ notice, in respect of any change to your membership conditions.

4.1.2 We will give you at least 14 days’ notice, of any proposed price increase of your membership.

4.1.3 In the event that a material change or a price increase is made to your membership terms and conditions, you shall be entitled to terminate your membership by providing one full calendar months’ notice to us as outlined in 2.4.1, within fourteen days of receiving the notice of the material change or the price increase.

4.2 CANCELLING OR CHANGING YOUR MEMBERSHIP

4.2.1 Subject to the provisions of this clause you cannot cancel or downgrade your membership during its minimum term. The minimum term for each membership is set out above and is repeated as follows: Results Membership (6 month or 12 months plus any relevant notice period (if applicable); Flexible Membership (3 months) Advance Paid Membership (6 months or 12 months).

4.2.2 You may only cancel or change your membership to another type during its minimum term if the following exceptional circumstances apply:

(i) You suffer a long-term illness or injury;

(ii) You become pregnant;

(iii) You lose your livelihood or have a change in your principal place of work or home

If any of the above exceptional circumstances apply, we shall be entitled to request reasonable evidence to provide sufficient proof of the exceptional circumstance. The decision as to whether the membership can be cancelled shall remain in our absolute discretion.  If we agree to cancel your membership in exceptional circumstances the notice period shall be 1 paid calendar month for all types of memberships.

4.2.3 Any change to your membership must be made by you by 20th of the month either online, or by calling the Member Services Team or sending an email to memberservices@village-hotels.com. Any changes made shall incur a reasonable administration fee (details of such notice periods and administration fees are available on request). Changes to your membership requested after 20th of the month may not be valid until a later month.

4.2.4 Any cancellation of your membership must be made by you by calling the Member Services Team or by sending an email to memberservices@village-hotels.com. Cancellation of your membership requested after the required notice period may not be valid until a later month. For all cancellations we require a cancellation reason and requested date to stop the membership.

4.2.5 Joining fees and subscriptions will not be refunded, save in the event of a serious breach of these terms and conditions on our part.  We hope that our Village Gym provides everything you expected.  However, if you do change your mind within 10 days of your start date, we will allow you to cancel your membership but your joining fee, or if no joining fee was payable a minimum of £15, will not be returned by us and will not be refunded.

4.2.6 Junior (under 14 yrs), 14-15 yrs & Young Persons (16 - 22 yrs) memberships will be based on age and, if relevant, will automatically increase from the month following each birthday, moving to the membership category relevant to their age. When a child becomes 18yrs old they will become an adult member and the responsibility for the membership agreement will transfer to them from the parent/guardian.

4.3 CHANGING YOUR DETAILS

It is your obligation to ensure that your contact details are up to date. Please ensure any changes to your postal or email address or telephone number are notified to us. We cannot be responsible for any communications that you do not receive because you did not update your contact details with us.

4.4 PAYING YOUR MEMBERSHIP FEE

4.4.1 If you do not pay your membership fee we will contact you to let you know.

4.4.2 We may refer any missed payments to a debt collection agency.

4.4.3 If you do not pay your membership fees for more than 30 days, we may at our discretion charge you an administration fee of £25. We may also charge you an administration fee of £10 for each missed payment.

4.4.4 If you do not pay for your membership we will prevent you from using the gym.

4.4.5 If you want to change your direct debit mandate from one bank to another you can change this by either using your online account, by calling member services or sending an email to memberservices@village-hotels.com by the 20th of the month. Failure to do so will result in the payment being requested from your existing bank account – should there be insufficient funds to cover the payment you may incur bank charges.

4.5 PRICING

4.5.1 We reserve the right to increase prices of the membership at any point during the term of the membership. We will give you at least 14 days’ notice of any price changes.

4.5.2 We reserve the right to pass on in full any changes in the prevailing rate of Value Added Tax (V.A.T.).

4.5.3 When a standard price increase is made, you are entitled to terminate the remainder of the membership by providing one month’s notice to us, within fourteen days of receiving notice of the increase.

4.6 FREEZING MEMBERSHIP

4.6.1 You may request to freeze your membership via your online member’s account or by contacting the Member Services Team. You must notify us by calling the Member Services Team or by sending an email to memberservices@village-hotels.com by the 20th of the month prior to your freeze start date. Membership may be frozen at our absolute discretion for a minimum of 1 month and a maximum of 12 months, such period to be agreed at the time of freezing the membership.

4.6.2 A charge of £10.00 per month will be levied for the duration of the freeze period.

4.6.3 Full membership fees will be re-instated and will commence from the agreed commitment to return date received from you.

4.6.4 Periods during which the membership is frozen do not form part of the continued duration of a Results Membership and periods for which the membership is frozen will be added on to the contract term, extending the minimum term.

4.6.5 You must fully re-instate your membership subscription from frozen to active membership before terminating your membership, giving the required notice period as set out in clause 2.4.1.

4.6.6 You will not have access to use the club facilities during periods of freeze.

USING THE CLUB

5.1. MEMBERS’ ACCESS

5.1.1 You will receive a membership card (or other membership pass prescribed by us from time to time) to gain access to your Home Club.

5.1.2 An administration fee will be charged to you for a replacement membership pass

5.1.3 We reserve the right to refuse entry to the gym without a membership pass.

5.2. USING OTHER CLUBS

5.2.1 Subject to clause 3.1 you can use other Village gyms in the Village group subject to you either upgrading your membership or paying a daily guest fee. Please note that access to the Village gyms at Village Hotel Aberdeen, Village Hotel London Watford, Village Hotel Eastleigh and Village Hotel Bracknell requires a daily guest fee in all circumstances

5.2.2 Members’ visits to their Home Club must be a greater number than visits to other Village gyms, over a rolling three months’ period. If the member uses other Village gyms more than their Home Club, Village has the right to transfer the membership to the club used the most. This may mean the member having to pay a higher membership fee.

5.3. CHILDREN

5.3.1 Each adult member can apply, at Village gym for a maximum of three junior memberships, for children up to & including 13 years of age.

5.3.2 At the age of 14 years, junior members may move to an upgraded 14-15 years’ membership and use all the facilities (subject to the terms and conditions of membership, the terms and conditions of use and the completion of a General Health Questionnaire prior to using the gym and/ or classes). A full Fitness Orientation must take place prior to joining onto this upgraded category.

5.3.3 Children must be supervised at all times as follows:

(i) All children aged 13 and under must be supervised directly by a parent or guardian, aged 18 or over. Those 14 and 15 year old must have a parent or guardian in the club at the same time at which they are in attendance.

(ii) There must be at least one parent or guardian for every child under the age of 5 years.

(iii) There must be at least one parent or guardian for every two children between the ages of 5 and 8 years.

5.3.4 No child under the age of 14 years is allowed in the pool area unattended.

5.3.5 Children, including junior members under 14 years, must be accompanied and supervised at all times by a parent or guardian, unless attending supervised junior activities. Those aged 14-15 years may use the gym providing their parent / guardian is an active paying member and in the club with them, they are on a 14 - 15 year membership and they have completed a Fitness Orientation.
Children remain the responsibility of their parent or guardian at all times while on Village premises and their parent or guardian agrees to ensure that each child adheres to the applicable terms, conditions, rules and regulations. Children may not use the fitness and aerobics studio (except during designated, supervised sessions), whirlpool spa, steam room or sauna.

5.3.6 Children over the age of 8 years should use own sex changing rooms.

5.4. GUESTS

5.4.1 Subject to availability you may introduce up to two guests on any day to the gym. Guests must register, complete a club waiver form, pay the current guest fee (details of which shall be provided on request) and must be accompanied by you. We are not able to take advanced booking for guests.

5.4.2 You must ensure that your guests are fully aware of and adhere to the applicable, terms, conditions, rules and regulations.

5.5. LOCKERS

5.5.1 For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.

5.5.2 All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.

5.6. ADVANCE BOOKINGS

5.6.1. You may book any bookable facilities up to 7 days in advance online via your online member access area or at the booking terminals within the Club.

5.6.2. All booked facilities/activities will be automatically checked in when swiping into the Club. This must happen prior to the activity starting otherwise your place maybe taken by another member.

5.6.3. Any facilities or classes can be cancelled a minimum 4 hours before the start time and will incur no penalties. Any classes that are cancelled after the 4 hour cut off period cannot be cancelled online. In the event of not cancelling 4 hours prior to the start or a no show will incur a penalty strike. Three penalty strikes accumulated in a 30 day period will result in a suspension of booking privileges for a 14 day period. To cancel a class after the 4 hour cut off period has passed can only be done by contacting the Club and requesting to cancel. No penalty will be applied if the space is filled by another member. Booking penalties can be appealed by contacting the Club Manager.

5.7. SMOKING

Smoking and the use of vapours is prohibited in all areas of Village premises.

5.8. PERSONAL BELONGINGS

We do not accept liability for loss, theft or damage to any personal belongings.

GENERAL USE

2.1 Prior to using any facilities at a Village gym you must complete a General Health Questionnaire. If there are some answers that indicate you have a medical condition, we may require a doctor’s note.

2.2 You must advise staff of any disability, including but not limited to blindness, deafness, heart condition and epilepsy, prior to using the facilities. This will help us in seeking to avoid accidents, injuries or misadventures to you and others.

2.3 While using the facilities you accept responsibility for your state of health and physical condition. You should not take part in any physical activity that you may not be fit for. If you suffer any unusual symptoms when using the gym facilities, you must immediately stop the activity and tell a member of staff.

2.4 You must not use the facilities if you have an infectious disease or condition.

2.5 If you or any guest or child that is with you suffers an accident or injury on the Village premises, it must be reported immediately to the most senior staff member on duty.

2.6 You must behave appropriately, respectfully and dress appropriately whilst on Village premises.

2.7 No pets are permitted on Village premises or its grounds, with the exception of registered working assistance dogs.

2.8 Smoking and use of vapours is prohibited in all areas on the Village premises.

2.9 No illegal gaming and betting is allowed on Village premises.

2.10 Shaving should be restricted to the vanity areas provided and is not permitted at any time in the shower, steam room, sauna or any other part of the gym.

2.11 All facilities may not be available at all gyms.

2.12 It may be necessary for us to close or withdraw all or any part of the gym facilities at any time for repair, maintenance, alteration or for safety reasons.

STUDIO ACTIVITIES

3.1 You must wear appropriate clothing and footwear at all times.

3.2 For your health and safety you must warm-up before taking part in any classes. If you arrive after the warm-up you may be excluded from participating for safety reasons.

3.3 Drinks may only be taken into the aerobics studio in a plastic re-sealable container

FITNESS STUDIO

4.1. In the interest of safety, no person under the age of 14 years will be admitted to the gym on their own (except during designated, supervised sessions). 14 - 15 year olds may only be admitted to the gym providing their parent or guardian is in the club.

4.2 All equipment has been designed and tested to be safe with the correct use. You must ensure for your own safety that you receive full instructions before using such equipment.

4.3 You must obtain prior permission to use the studio for a non-timetabled class.

4.4 You must only attend a class on which you have pre-booked in advance or on the day.

LEISURE POOL AREA

5.1 You must shower on entering the pool area, especially before and after using the sauna or steam room, and always shower immediately before entering the spa pool.

5.2 You must read and observe the notices displayed in the pool area.

5.3 You must at all times follow the rules and guidelines displayed, and any other instructions given by Village staff, regarding the use of the pool, spa, sauna and steam room.

5.4 For safe spa bathing, visits are limited to a maximum of 15 minutes.

5.5 No child under the age of 14 years is allowed in the pool area without the supervision of a parent or guardian aged 18 or over. The parent or guardian shall ensure that the child is fully aware of and adheres to these General Terms and Conditions of Use and to any gym specific rules and regulations. 14 - 15 year olds may only be admitted to the pool area providing their parent or guardian is in the club.

5.6 Children not yet toilet-trained must wear an appropriate swim nappy.

5.7 Children must vacate the pool immediately at the end of the designated children’s swimming time. Children’s swimming times may vary slightly from gym to gym - please check published opening times displayed in the gym or on our website.

5.8 You must not enter the pool while under the influence of alcohol or after a heavy meal.

5.9 A poolside telephone or alarm is provided in case of emergency.

5.10 Mobile Phones and any other recording devices are strictly prohibited in the Leisure Pool Area.

CAR PARKING

6.1 You are only entitled to use the car park whilst you are using the facilities.

6.2 Cars must be parked correctly in the car park, giving due attention and priority to disabled users.

6.3 Cars are parked at the owners own risk. We do not accept liability for any loss or damage to vehicles or personal belongings.

6.4 Car parking is not guaranteed at any of the Village premises.

LOCKERS

7.1 For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.

7.2 All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.

7.3 If you lose your wristband or pass then there may be a change to replace these.

TANNING FACILITIES

8.1 Sunshower(s) and sunbeds are available on a queuing basis.

8.2 You must read the health and safety guidelines relating to safe tanning, available from the Village gym reception, before using the tanning facilities.

8.3 Appropriate goggles must be worn at all times in a UVA/UVB environment.

8.4 Tanning facilities are not available to persons under the age of 18 years, in accordance with current legislation.

PHOTOGRAPHY AND VIDEOS

9.1 You must not take photographs or videos of any children under the age of 18.

9.2 You must not take photographs or videos of any other members without their express consent. You must get this consent before photographing or videoing any other member.

9.3 You must not take photographs or videos in a changing area, pool, sauna, steam room, spa or toilet area.

9.4 We may ask you to stop taking photographs or videos and delete them as appropriate.

9.5 Subject to the provisions set out above you are permitted to take photographs or videos of yourself for your own personal use only.

SOCIAL MEDIA

10.1 We operate a safe environment for our staff and guests. As part of that safe environment we ask all guests to use social media in an appropriate manner, having regard to other individual’s privacy.

10.2 Any use of social media identifying our staff or our guests or revealing their personal details will be taken as a serious breach of these terms and conditions and may result in your membership being terminated.

TERMINATION/SUSPENSION

11.1 We reserve the right to terminate membership for any of the following:

11.1.1 breach of rules and regulations;

11.1.2 serious breach of these General Terms and Conditions of Use;

11.1.3 conduct which, in our reasonable opinion, is damaging to the character or interest of the Village gym, or is offensive to other members or staff, hazardous to the health and safety of other members or staff or of significant impediment to the enjoyment of other members.

11.2 We retain absolute discretion to reject any application or renewal of membership without giving any reason for doing so.

11.3 Membership of the gym may be suspended by us if there are any irregularities regarding payments. We reserve the right to appoint a third party to recover outstanding membership fees. Access to the gym may at our discretion be denied until these issues have been resolved. If we think it is appropriate, acting reasonably and at its own discretion, the membership will be terminated.

LIABILITY

12.1 We do not accept liability for any loss or damage to your property that may happen whilst on Village premises, unless such loss or damage is caused by our negligence.

12.2 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude Village’s liability for death or personal injury caused by its negligence, or any liability for fraud.

12.3 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude any rights that members have as consumers.

12.4 We are not responsible for any harm that you suffer as a consequence of using Village gyms and their facilities, unless such harm is caused by our negligence.

DATA PROTECTION

13.1 We agree to comply with all relevant Data Protection Legislation which for the purpose of this Agreement shall mean the UK Data Protection Legislation and any other European Union legislation including the General Data Protection Regulation 2018 relating to personal data and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data (including, without limitation, the privacy of electronic communications)

13.2 We hold any information that you provide to us in accordance with our privacy policy on our website.

GOVERNING LAW

These terms and conditions and any disputes shall be governed by English Law and the parties submit to the courts of England and Wales.

PAYMENT TERMS AND CONDITIONS

Privacy Information

Village Gym, as part of Village The Hotel Club process personal information collected for the purposes of, dealing with your requests, providing reservation services, tailoring our services to your requirements and preferences, conducting market research surveys and providing you with information about products and services we offer. We will not sell this information and will only disclose it to other companies within Village The Hotel Club and any suppliers we engage to process data on our behalf.

Direct Debit Guarantee                                                                                        

This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.  If there are any changes to the amount, date or frequency of your Direct Debit, Village Hotels will notify you 10 working days in advance of your account being debited or as otherwise agreed. If you request Village Hotels to collect a payment, confirmation of the amount and date will be given to you at the time of the request. If an error is made in the payment of your Direct Debit, by Village Hotels, or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society.  If you receive a refund you are not entitled to, you must pay it back when Village Hotels asks you to. You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.
